Who enforces the code: counties and municipalities

South Carolina has a statewide code and local enforcement. The statute puts the work on every county and municipality: ‘All municipalities, as defined by Section 5-1-20, and counties in this State shall enforce building, energy, electrical, plumbing, mechanical, gas, and fire codes, referred to as building codes in this chapter’.

A permit for your job comes from the building department of the county or municipality where the house sits, not from a state office.

S.C. Code § 6-9-10

The Building Codes Council adopts the codes

The state body is the South Carolina Building Codes Council, which sits within the Department of Labor, Licensing and Regulation (LLR). By statute it adopts ‘building, residential, gas, plumbing, mechanical, fire, and energy codes as promulgated, published, or made available by the International Code Council, Inc. and the National Electrical Code as published by the National Fire Protection Association’.

LLR describes the effect for local governments: ‘The mandatory codes referenced in S.C, Ann. §6-9-50(1976, as amended), modified and adopted by the South Carolina Building Codes Council (Council), must be enforced by every South Carolina municipality and county.’

Codes in effect now: 2021 editions

LLR’s adoption page states: ‘The South Carolina Building Codes Council adopted the 2021 South Carolina Building Codes at their meeting on October 6, 2021. The Council approved an effective date of January 1, 2023.’

The list of mandatory codes, as LLR prints it, includes ‘2021 South Carolina Residential Code or the 2021 International Residential Code with SC modifications’ and ‘2021 South Carolina Mechanical Code or the 2021 International Mechanical Code with SC modifications’.

What changes next: 2024 editions, January 1, 2027

The Council’s 2024 modification index says: ‘On August 26, 2025, the South Carolina Building Codes Council (the “Council”) adopted the latest editions of the mandatory codes and select appendices with modifications’, and ‘The Council established the implementation date for local jurisdictions as January 1, 2027.’

The notice that opened the cycle listed ‘2024 Edition of the International Residential Code’ and ‘2024 Edition of the International Mechanical Code’. Until that date, the 2021 editions above are the ones LLR lists as in effect; the cut-over rule for applications submitted near the date is Not verified here.

How Council modifications work

South Carolina does not take the ICC books unchanged. The Council reviews requests and may alter them: ‘The council may modify or amend the code after a finding on the record that the modifications provide a reasonable degree of public health, safety, and welfare.’

LLR’s 2021 adoption notice adds: ‘Only the modifications approved and listed on the Council’s website are valid for use in the State.’

Energy code: a statute, not the IRC chapter

Residential energy compliance in South Carolina does not run through the IRC’s energy chapter. The Energy Standard Act says: ‘The 2009 edition of the International Energy Conservation Code is adopted as the Energy Standard. All new and renovated buildings and additions constructed within the State must comply with this standard.’

The Council’s modifications remove the competing chapter. The 2021 document reads: ‘The Building Codes Council does not adopt IRC Chapter 11.’ The 2024 index gives the reason: ‘The State of South Carolina has specific energy standards in statutory form’, and the chapter is ‘(Chapter deleted without substitution)’. LLR notes ‘Future updated versions must also be adopted by statutory amendment.’

Permit and plan review

The energy statute describes the local official’s job: ‘The building officials are responsible for examination and approval or disapproval of plans and specifications, the issuance and revocation of building permits, licenses, certificates, and similar documents, and the inspection of buildings pursuant to the provisions of the Energy Standard.’

The state has no single submittal list. LLR states the split: ‘Administrative policies and procedures are the sole responsibility of each local jurisdiction.’ Whether a like-for-like equipment replacement needs its own mechanical permit, and what that permit asks for, is Not verified at the state level; it is the local department’s call.

Load calculation (Manual J / S)

Varies by local department — not set as a statewide submittal rule that we could find. We searched the Council’s 2021 modifications and 2024 index for “Manual J”, “Manual S”, “load calc” and the IRC equipment-sizing section M1401.3 and found no modification touching it. That is our reading of silence, not a statement by the Council. We could not retrieve ICC’s own text of M1401.3, so its wording is Not verified here.

What local departments actually ask for differs. Three South Carolina departments’ own checklists: Calhoun County lists ‘Manual J & D ( This is the sizing for the HVAC unity and the duct. )’; the City of Walhalla lists ‘Project specific Manual J & D HVAC design (project address and square footage must be included).’; and the Town of Ridgeland has two versions of its list online that disagree, one reading ‘Manual J, S, & D for HVAC (supplied by HVAC Contractor)’ and another ‘Manual J for HVAC (Supplied by HVAC Contractor)’. We have not established which Ridgeland version is current. These are examples, not a statewide rule.

Duct design (Manual D)

Varies; not set by the state. The state documents we read do not name Manual D. Some local departments list it with the load calculation (Calhoun, Walhalla, one Ridgeland version) and others do not.

Refrigerant suction-line insulation

One Council modification touches residential split systems directly. The 2021 text reads: ‘Pipings and fittings for refrigerant vapor (suction) lines shall be insulated with insulation having a thermal resistivity of at least R2.5 hr. ft2 F/Btu’. The 2024 index continues the modification as M1411.12; we are not quoting its 2024 R-value because the index shows added and struck text and we could not separate them reliably.

Contractor licensing

HVAC contractors in South Carolina are licensed by the state. LLR’s Contractors’ Licensing Board page says it ‘regulates the license, certification or registration of general and mechanical contractors’. The statute defines the work: ‘“Mechanical construction” means the installation, replacement, or repair of plumbing, heating, air conditioning, process piping, refrigeration, lightning protection equipment, or electrical components, fixtures, or devices of any kind, excluding burglar alarm work.’

Dollar thresholds and exam rules are Not verified here; use the Board’s pages.

Climate zone

Not verified. The state documents we read do not assign a climate zone, and we are not filling one from memory. Confirm it with the building department.

Verified against official sources on 2026-10-12. Codes and local policies change, so confirm with the building department before you submit. Send us the address and we will check it for you.

Questions

Which residential code does South Carolina enforce right now?

The 2021 South Carolina Residential Code, which is the 2021 International Residential Code with state modifications, effective for local jurisdictions on 1 January 2023. The Council adopted 2024 editions on 26 August 2025 with an implementation date of 1 January 2027.

Who issues HVAC permits in South Carolina?

Counties and municipalities. The Building Codes Council writes the code, but state law makes every county and municipality enforce it, so you apply to the local building department. Submittal lists are set locally.

Does South Carolina require a Manual J for a permit?

Not as a statewide submittal rule that we could find. Some local departments list it, for example Calhoun County and the City of Walhalla ask for Manual J and D. Confirm with the department that will issue your permit.

What energy code applies to houses in South Carolina?

The 2009 International Energy Conservation Code, adopted by the Energy Standard Act. The Council deletes the IRC energy chapter, and updating the standard requires a statutory amendment.
