Lee County, FL HVAC permit requirements
What the adopted code says, what the permit office actually collects, and where each answer comes from.
Who permits HVAC work
Lee County Community Development runs Building & Permitting Services at 1500 Monroe St., Fort Myers. Its Mechanical Guide says: ‘A Mechanical permit is required for installation, alteration, or replacement of any mechanical or system equipment, such as but not limited to: Any HVAC equipment, ductwork, walk in cooler/freezer, kitchen ventilation elements such as heat hoods (Type II), exhaust ductwork and fans.’
The exemption is narrow: ‘Work exempt from permit per Florida Building Code, Building Chapter 1, section 105.2 will include portable HVAC equipment or replacement of any part that does not alter its approval or make it unsafe.’
Lee County Mechanical Guide (Last Updated 12/19/2023) Lee County Building & Permitting ServicesAdopted code and energy code
The Mechanical Guide lists ‘Florida Building Code 8th Edition (2023)’, including ‘Florida Building Code - Mechanical, Energy Conservation, Existing Building, and Fuel Gas Code.’ The Residential Building Guide (Last Updated 12/23/2025) names the same edition. The Florida Building Commission states: ‘The Effective Date for the Florida Building Code, 8th Edition (2023), is December 31, 2023.’ We found no Lee County statement about a later edition.

On plans, the county is explicit: ‘Like-for-like replacements of condensing unit /air handler do not require plans.’ That is a statement about plans, not a waiver of the permit. The online form collects: ‘AC Details: Row(s) for Type of system, Action, Conditioned Area (SqFt), AC (kw), BTU (heat pump), Seer, Tons’ and ‘Product Information: Row(s) for Condenser/Air Handler, Manufacturer, Model’. The “New/Replacement/Other” choices are ‘Disconnect/Reconnect, New, Replace’.
Lee County Mechanical Guide Lee County Trade Permit Application (10/2025)New A/C systems and new construction
For new systems: ‘For NEW A/C units (not change-outs; or mini- splits), include:’ ‘Heater size;’ ‘Energy calculations; and’ ‘Duct layout.’ For a new house or living-area addition, the Residential Building Guide says: ‘ENERGY CALCULATIONS (SFR, DUPLEX AND/OR ALL LIVING AREA ADDITIONS) must be submitted in compliance with Florida Building Code 8th Edition (2023) energy conservation guidelines.’ The plan-details page adds: ‘If living area, three sets of current building code energy calculations will be required.’
On testing: ‘If energy testing is required, then the dwelling will be tested for air leakage rates.’ The county blower-door form states two air-leakage limits by climate zone and does not say which zone Lee County is in.

Inspect. Common inspections are ‘401 Rough A/C’ and ‘402 A/C Final’. ‘Issued permits must pass at least one inspection within 180 days from issuance or the permit will expire.’ Contact: 239-533-8329, [email protected].
Lee County Mechanical Guide Application & Information Center (eConnect)Hurricane and disaster-event rules
The county keeps a standing Disaster Recovery page: ‘Following a disaster event, permitting procedures may be modified to support recovery and rebuilding efforts.’ The page and its requirements PDFs say “disaster event” or “Hurricane Damage” and name no storm. For mechanical work the requirements list ‘Mechanical, Electrical, or Plumbing (may require Plan Review)’ with ‘Floor Plan’ and ‘Detailed Scope of Work’.
‘The Federal Emergency Management Agency (FEMA) 50% Rule is still in effect and will be enforced during permit review for properties located in regulated flood hazard areas.’ The trade-permit affidavit has the owner acknowledge that ‘all repairs and improvements to my property, located within a Special Flood Hazard Area (SFHA), must be properly permitted, including those typically exempt from permitting’.
Lee County Disaster Recovery page Disaster Recovery Permitting Requirements (Phase III) 50% Rule affidavit for trade permitsLoad calculation (Manual J / S)
Not verified as a county requirement. We read the Mechanical Guide, Residential Building Guide, plan-details page, trade application, disaster-recovery documents and the county forms named above. None contains “Manual J”, “Manual S” or “load calculation”. The county does write ‘Energy calculations’ for new A/C units and new living area. An energy calculation is not a Manual J. We did not read the eConnect user guide, which could say more.
Lee County Mechanical GuideDuct design (Manual D) and Form 405
Manual D: not verified. The county asks for a ‘Duct layout.’ on new A/C units and lists ‘Duct systems;’ in its plan-review criteria. It never names Manual D.
Form 405: not verified. The documents refer to energy calculations under the 8th Edition energy code and name no form number. Confirm the energy form with the permit office.

The Residential Building Guide says ‘If project value is greater than $5,000, submit the completed Notice of Commencement to the Lee County Clerk of Court’. The guides are dated 12/19/2023 and 12/23/2025. We did not resolve it.
